Music Teacher Pros ("Company," "us" or "we") recognises that your privacy is important. This Policy explains how we collect, use and protect personal information relating to you and your clients ("Clients") through our website (the "Site") and related products and services (the "Service").
We may update this Policy from time to time. We will notify you of significant changes by email to the address on your account and/or by posting a notice on the Site. Your continued use of the Site and Services after any change constitutes acceptance of the updated Policy.
By using this Site and our Services, you agree to the practices described in this Policy. We only process personal data where we have a lawful basis to do so, as set out below.
1. Our lawful bases for processing
We only process your personal data where we have a lawful basis to do so. Depending on the situation, we rely on one or more of the following:
• Contract— to provide our services to you and manage your account (for example, setting up and running your platform, providing support, and taking payment).
• Legitimate interests — to operate, secure and improve our website and services, to understand how they are used, and to send existing clients relevant information about our services. Where we rely on legitimate interests, we make sure they are not overridden by your rights.
• Consent — for optional marketing communications to prospective clients and for non-essential cookies. You can withdraw consent at any time.
• Legal obligation — where we must process data to comply with the law (for example, keeping financial records).
Where we act on behalf of our clients (processing the personal data of their leads and customers through our platform), we do so as a processor on the client's instructions. That relationship is governed by our Data Processing Agreement at musicteacherpros.com/dpa.
2. Types of Information We Collect
We collect two types of information: Personally Identifiable Information ("PII") and Aggregate Information.
Personally Identifiable Information is information that identifies you. When you register for an account, purchase a product or service, submit content, or contact us, we may ask for information such as your name, email address, mailing address, employer, job title, telephone number, and payment card details if purchasing a product or service.
Aggregate Information does not by itself identify a specific individual. It may include the URL you came from, the URL you visit next, your browser type, and your IP address.
3. How We Collect and Use Information
Music Teacher Pros do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use certain products or services available on the Site. These may include: (a) registering for an account on our Site; (b) uploading individual transaction data obtained from your third-party invoicing or accounting applications (for example, “Stripe,” etc.), (c) uploading user generated content and other information uploaded to the Site (d)sending us an email message; (e) submitting a form or transmitting other information by telephone or letter; or (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site.
We will primarily use your PII to provide product or service offerings to you. We will also use certain forms of PII to enhance the operation of our Site, improve our internal marketing and promotional efforts, statistically analyze Site use, improve our product and service offerings, and customize our Site’s content, layout, and services. We may use certain information about you without identifying you as an individual to third parties. We do this for purposes such as analyzing how the Service is used, diagnosing service or technical problems, maintaining security, and personalizing content. We may also use PII to deliver information to you and to contact you regarding administrative notices. Finally, we may use your PII to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Site Terms of Use, and this Privacy Policy.
We may also collect or our third party advertising partners may collect, certain Aggregate Information. For example, we may use your IP address to diagnose problems with our servers, software, to administer our Site and to gather demographic information. Our third party advertising partners may also provide us with aggregate, but not individual, reports that will tell us how many ads were presented and clicked upon at out Site.
4. Cookies
We use cookies and similar technologies on our website. Some are essential for the site to function. Others are analytics and advertising cookies — including the Meta Pixel and Google Analytics/Ads tags — which help us understand how our site is used and measure and improve our advertising. Non-essential cookies are only set with your consent, which you can give or withdraw at any time using the cookie banner on our site. You can also control cookies through your browser settings. Disabling some cookies may affect how the site works.
5. Release of Information
We will not sell, trade or rent your PII. We share PII with service providers, partners and other third parties ("Service Partners") only as needed to deliver our products and services — for example, payment processors to take payment, or support tools to help us assist you. Our Service Partners' use of PII is governed by their own privacy policies. Other sites accessible through this Site have their own privacy practices, for which we are not responsible.
We may disclose PII where required by law, or in response to a valid court order, subpoena or law enforcement request. We may also provide Aggregate Information (which contains no PII) to third-party advertisers.
6. International data transfers
Our platform is provided using infrastructure operated by HighLevel Inc. which is based in the United States. As a result, some personal data is transferred to and processed in the United States and other countries outside the UK. Where we transfer personal data outside the UK, we make sure it is protected by an appropriate safeguard recognised under UK data protection law — such as the UK International Data Transfer Addendum to the EU Standard Contractual Clauses, and/or our provider's certification under the UK Extension to the EU–US Data Privacy Framework.
7. Your rights and how to complain
Under UK data protection law you have the right to:
• access the personal data we hold about you;
• request rectification of inaccurate or incomplete data;
• request erasure of your data;
• request that we restrict our processing of your data;
• data portability — receive your data in a portable format;
• object to processing based on our legitimate interests, and to object to direct marketing at any time; and
• withdraw consent at any time where we rely on it.
You can update or correct much of your account information yourself by logging into your account. To exercise any of your other rights, contact us at [email protected], and we will respond within one month. Please note we may need to retain certain information (such as records of past transactions) where the law requires or permits it, and some residual data may remain in backups.
If you are unhappy with how we have handled your personal data, you have the right to complain to the UK Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113. We would appreciate the chance to resolve your concern first, so please do contact us.
8. User Choices on Collection and Use of Information
We may, from time to time, send you email regarding new products and services that we feel may interest you. In addition, if you indicated upon registration that you are interested in receiving offers or information from us, we may occasionally call or send you direct mail about products and services that may be of interest to you. Only Music Teacher Pros will send you these solicitations, and only if you have previously indicated that you wish to receive them. If you do not want to receive solicitations from us, you can “opt-out” by accessing your account online editing your account information to no longer receive such offers and mailings, or unsubscribe from our mailing list.
You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Site may not work properly in your case.
9. Security
We take appropriate security measures to protect your PII against unauthorised access, alteration, disclosure or destruction. We encrypt PII in transit, limit access to those who need it, and use physical, electronic and procedural safeguards. Card transactions are handled by established third-party payment processors (such as Stripe).
No transmission over the internet can be guaranteed 100% secure, so while we work to protect your data, we cannot guarantee its absolute security. If a breach affecting your PII occurs, we will notify affected individuals and the relevant authorities as required by law.
10. General
You must be at least 18 years old to use this Site. We do not knowingly collect PII about minors. Information you disclose in any public areas of the Site may be collected and used by others, which is beyond our control.
11. Our role under the GDPR (processing on behalf of clients)
Our clients use the Music Teacher Pros software to collect and process personal data, which may include individuals in the EU and/or the UK — for example, managing their marketing lists and campaigns.
For the purposes of the EU GDPR and UK GDPR, Music Teacher Pros acts as a processor of that personal data. The controller is either our client or the customers of our client. We process such data only on the client's instructions and in line with our obligations as a processor. A Data Processing Agreement is entered into between us and each client, available at musicteacherpros.com/dpa, setting out the safeguards that apply.
